By signing up for a membership with Puerto Vallarta Mercado, you agree to the terms of this acceptable use policy, and to abide by rules and regulations displayed on Puerto Vallarta Mercado. Puerto Vallarta Mercado may amend these terms from time to time. If you do not agree to the changes, you must request that your account be closed. Your continued use of our service will signify your acceptance of the updated terms. Please remember, all payments made to Puerto Vallarta Mercado are NON-REFUNDABLE.
Puerto Vallarta Mercado acts as a venue which individuals may use to buy, sell, or trade their items in a comfortable and enjoyable setting, at anytime, from anywhere. We do not own or handle any of the items or services listed by users on this site. As a result, we cannot verify or endorse the quality, safety, or legality of the posted ads, or the truth or accuracy of the content on our site. Please remember - 'Caveat Emptor' or 'buyer beware'.
Content :
You agree that your information and the content you post on Puerto Vallarta Mercado will:
- be true, accurate, and up-to-date;
- not be fraudulent or involve the sale of stolen items;
- not violate any law;
- not be defamatory, trade libelous, unlawfully threatening, or unlawfully harassing;
- not be obscene or contain child pornography;
- not link directly or indirectly to, or include descriptions of goods or services that,
- are prohibited under this Agreement or
- you do not have a right to link to or include; are not in accordance with Puerto Vallarta Mercado's Rules and Regulations.
Fees and Services :
Browsing and selling items on Puerto Vallarta Mercado is completely free. Because of the open concept involved with this setup and the abuse that can be incurred, Puerto Vallarta Mercado reserves the right to queue & review all messages posted without an account. When you sign up for an account, your messages will be displayed instantly without going into the queue.
License :
Any information you or anyone else posts on Puerto Vallarta Mercado (ie ... text or images) remains the sole property of Puerto Vallarta Mercado. You agree to grant us a nonexclusive, worldwide, perpetual, irrevocable, royalty-free right to exercise the copyright and publicity rights you have in your posted content, in any media now known or not currently known.
Information Removal :
Any information you or anyone else posts on Puerto Vallarta Mercado (ie ... text or images) remains the sole property of Puerto Vallarta Mercado and can be disposed of at our discretion. IF your post is deleted, Puerto Vallarta Mercado is in no way responsible for backing up, retrieving, or forwarding this information to you. YOU are responsible for keeping a backup of any post that you wish to keep a record of. All anonymous posts are deleted approximately every 30 days and CAN NOT be recovered.
Privacy :
Puerto Vallarta Mercado will only use your personal information in accordance with our Privacy Policy.
Disputes :
Puerto Vallarta Mercado is not involved in the actual transaction between buyers, sellers and traders. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. We are absolutely NOT responsible for resolving disputes between two different parties.
Puerto Vallarta Mercado Software :
You agree that you will not use any device, software, internet website, or routine to interfere or attempt to interfere with the proper working of the Puerto Vallarta Mercado site in ANY way, shape, or form. You may not take any action which imposes an unreasonable or disproportionately large load on our website.
Passwords :
You MAY NOT disclose or share your Password to any third parties or use your Password for any unauthorized purpose. Passwords may be shared between immediate family members in the same household. You may not give your password and username to a friend or post ads for friends to bypass the membership fee.
General :
Our service is provided "as is." We will try very hard to make your experience with Puerto Vallarta Mercado a comfortable and enjoyable one; however, we cannot always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data or other service interruptions. For this reason, you agree that Puerto Vallarta Mercado's services are provided "as is." We cannot assume responsibility for the timeliness, deletion, misdelivery, or failure to store any Member data, communications, or personalization settings. WE AND OUR SUPPLIERS PROVIDE THE Puerto Vallarta Mercado WEBSITE AND OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED.
Suspension/Termination :
Puerto Vallarta Mercado is generally quite lenient with enforcement of rules. But for very serious cases, the ADMINISTRATOR may temporarily suspend, indefinitely suspend, or terminate your membership at any point if any of your current ads, actions towards moderators or the administrator, or any other information you place on the site is in breach of this agreement or our rules and regulations.
Limit of Liability :
IN NO EVENT SHALL WE OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. OUR LIABILITY, AND THE LIABILITY OF OUR SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO $1 Peso
Notices :
Puerto Vallarta Mercado reserves the right to send paid members certain communications relating to the Puerto Vallarta Mercado experience, such as service outages or upgrade announcements, administrative messages and/or promotions, that are considered part of your Puerto Vallarta Mercado account, without offering you the opportunity to opt-out of receiving them. Please be assured that these communications will be from the Puerto Vallarta Mercado administration ONLY and no one else. If you do not wish to receive ANY email from Puerto Vallarta Mercado, please do not signup for an account.
